The project aims at revealing systemic problems in the implementation of general obligations deriving from Article 8 of the European Convention on Human Rights in the field of conducting operational intelligence activities, as well as selected components of the right to respect for private and family life, including remedies for victims of violations.
Although there are very few judgments on Article 8 adopted in respect of the Republic of Armenia which is stipulated by a scarce number of cases taken to the ECHR on these specific issues, both legislation and practice remain inconsistent with the Convention in a number of aspects.
The Project will indicate not only systemic issues and general measures stemming from the respective judgments adopted against Armenia, but also from judgments in respect of other CoE member states pertaining to similar issues. used for promoting compliance of domestic legal system with the Convention thus preventing findings of similar violations of the European Convention in the future. The LDPF will assess national legislation and practice in the light of Article 8 (in the field of conducting operational intelligence activities, as well as selected components of the right to respect for private and family life, including remedies for victims of violations) of the ECHR, as well as develop and promote a package of recommendations for bringing domestic legal system into compliance with the Convention thus ensuring human rights safeguards in the course of secret surveillance processes. The report will be published in the end of the project.
