The Ministry of Internal Affairs of Armenia circulated draft laws on Making Amendments to the Code on Administrative Offences of the RA and related laws, including the draft law on Making Amendments to the Law on State Duty on the e-draft platform. The Law Development and Protection Foundation has published an expert opinion on the latter, pointing out the problematic provisions and making respective recommendations.
In particular, the Ministry of Internal Affairs proposes to apply significantly higher state duty rates for the claims submitted to the Administrative Court against the Police and the bodies thereof compared to the claims brought against other administrative bodies.
The LDPF points to the fact that the Ministry of Internal Affairs has not substantiated the necessity to apply higher state duty rates. Moreover, according to the Foundation, the draft law poses risks for the violation of the right to equality and freedom from discrimination which is guaranteed by the Constitution of Armenia.
